Website Owner, Offering, and Binding of Terms

 

This website is owned and operated by Bloodknotcollective. These Terms set forth the terms and conditions under which you may use our website and services as offered by us. This website offers visitors merchandise, commission work, Patreon Only merchandise, and viewing galleries. By accessing or using the website of our service, you approve that you have read, understood, and agree to be bound by these Terms.

 

 

Who Can Use Our Site

 

In order to use our website and/or receive our services, you must be at least 18 years of age, or of the legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you.

 

 

Commercial Terms Offered to Customers

 

When buying an item, you agree that: (i) you are responsible for reading the full item listing before making a commitment to buy it: (ii) you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.

 

The prices we charge for using our services / for our products are listed on the website. We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur.

 

 

Shipping and Returns

 

Shipping 

 

​We ship via USPS first class mail. Shipping usually takes 1-5 business days in the US and 7-21 days internationally (although USPS doesn't guarantee delivery dates). We rate our shipping by product. Our watercolor paper prints (this includes prints for commissions) comes from our printing company. They will arrive separately from your other orders. They cost $8 to ship in the USA and $20 to ship internationally. Our holographic and cotton prints, cards, stickers and accessories are a $6 charge for the US and $20 for International. The rate for Apparel is $7 for US and $30 for international. Our commercial commissions include free shipping. The rate will be charged once for all products ordered from a group. ​Returns

 

We currently only accept returns for Teeshirts. For health and safety, we do not accept returns for bathing suits.You have 14 days after purchasing to return your item for a refund (purchase price only. Does not include shipping). You pay return shipping costs. All apparel must be in new condition and not worn or washed. Please email us at bloodknotcollective@gmail.com for a return shipping address.

 

Commission Terms 

 

All commissions must be purchased within 48 hours after we notify you the listing is active. If you don't purchase within 48 hours we will remove your listing and no longer hold your spot. We cannot guarantee your commission date until after purchase. We require full payments before we can secure your commission start date. 

 

By purchasing a commission you are agreeing to the following terms:

1. This commission is for commerical use. You will receive digital files via email. You will also be mailed a 8x10 inch print.

2. We require full payment before we can secure your commission start date. 

3. We work in raster and not vector. This is usually only an issue for tshirt printing. Make sure to check with your production company before purchasing. 

4. We send a 8x10inch canvas at 500dpi. We can send a vintage background, white background, and no background. We send JPEG and PNG files. 

5. We will give you a start date for your commission. You have one week to send reference and get in touch with us. If you do not send reference or contact us within one week after your start date, you will get refunded 50% of your purchase price and your commission will be canceled. The 50% we keep pays for the commissions we lost while holding your spot. 

6. You will have the option to make changes to the initial sketch before the inking and coloring process. You can make up to three changes for the sketching process and one change to the completed version. If you are still not satisfied with the drawing, you will get refunded 50% of your purchase price. The 50% we keep pays for our drawing time. Once you accept the completed drawing, you will no longer be able to make changes to the drawing. 

7. Commissions generally take 2 to 4 weeks to complete after your start date. We cannot guarantee completion times. Once your commission is complete, we will order your print. Production takes 3 to 5 days and then it will ship.

8. We do not guarantee that we will post your commission to our social media. Please let us know your Instagram/Twitter accounts if you are okay with us posting your commission.

Retention of Right to Change Offering

 

We may, without prior notice, change the services; stop providing the services or any features of the services we offer; or create limits for the services. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason.

 

 

Ownership of Intellectual Property, Copyrights and Logos

 

The Service and all materials (except commercial commissions) therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of Bloodknotcollective. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof.

 

 

Indemnification

 

You agree to indemnify and hold Bloodknotcollective harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the services offered on the website.

 

 

Limitation of liability

 

To the maximum extent permitted by applicable law, in no event shall Bloodknotcollective, be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service. 

 

To the maximum extent permitted by applicable law, Bloodknotcollective assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.

 

 

Right to Change and Modify Terms

 

We reserve the right to modify these terms from time to time at our sole discretion. Therefore, you should review this page periodically. Your continued use of the Website or our service after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the website or the service.

 

 

Promotional emails and content

 

If you subscribe to our email list, you agree to receive from time to time promotional messages and materials from us, by email. If you don't want to receive such promotional materials or notices – please just notify us at any time. 

 

 

Preference of Law and Dispute Resolution

 

These Terms, the rights and remedies provided hereunder, and any and all claims and disputes related hereto and/or to the services, shall be governed by, construed under and enforced in all respects solely and exclusively in accordance with the internal substantive laws of USA/ Oregon, without respect to its conflict of laws principles. Any and all such claims and disputes shall be brought in, and you hereby consent to them being decided exclusively by a court of competent jurisdiction located in Eugene Oregon. The application of the United Nations Convention of Contracts for the International Sale of Goods is hereby expressly excluded.
